457 Visa Changes [New TSS visa]

The current Subclass(457) Visa would be changed and replaced by the new TSS[Temporary Skills Shortage] Visa.

Here are some of the major changes that will take place.

• The TSS would have two streams. A short term stream and a medium term stream.

• Short term stream would entail a validity of 2 years. Only occupations from the STSOL list would be available here. There are no options of permanent visa through RSMS/ENS options in this.

• Medium term will be valid for a period of 4 years. Only occupations from the MLTSSL list would be available here. There are options of permanent visa through RSMS/ENS after working with the employer for 3 years.

• All current SBS approvals which continue to be valid past March 2018 do not need to reapply. Sponsorships obligations will apply for the TSS visa.

• The TSMIT requirement would be the same at $53900.

• Two years of relevant work experience would be required even to apply for TSS visa. Regardless of the stream.

• Labour market testing will apply for all visa applications• The foreign worker levy applies to TSS, ENS and RSMS applications. These contributions will go towards Skilling Australian fund.

   The contribution fees are:

• Small business (under $10 million in annual turnover)

•TSS: $1200 per year of part there of RSMS/ENS: $3000 one off payment

• Other businessesTSS: $1800 per year of part thereofRSMS/ENS: $5000 one off payment

• The TFNs of employer sponsored visa holders will be collected so that the Department will be able to discover if employees are being underpaid.
